Terms of Service

Welcome to Glowid. These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Sparking Labs Limited ("Sparking Labs," "Company," "we," "us," or "our"), the operator of the Glowid mobile application and related services (collectively, the "Service").

By downloading, installing, accessing, or using Glowid, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Glowid is not directed to children under 13. If you are between 13 and the age of legal majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.

1. The Service

1.1 Glowid is an AI-powered application that lets users generate and edit images and videos (e.g., text-to-image, image-to-image, text-to-video, image-to-video, and image enhancement) using artificial intelligence technology, including third-party AI model providers (see Section 3.4).

1.2 Certain features require access to your device's photo library and/or camera so that you can select or capture material to generate or edit content ("Input Media"). You may grant or revoke this access at any time in your device settings.

1.3 No facial recognition or biometric processing. Glowid does not perform facial recognition, facial detection, facial mapping, or extract any biometric identifiers (such as faceprints or facial geometry) from your photos or videos. Glowid's AI features operate on the image as a whole for general content generation purposes and do not identify, verify, or track any specific individual.

1.4 We may modify, add to, or discontinue features of the Service at any time. Material changes affecting your rights will be communicated through the app or these Terms.

1.5 Minimum age to use the Service is 13 years old, or the minimum age of digital consent in your country if higher.

2. Accounts

2.1 You may register using an email address, phone number, or a third-party sign-in method (e.g., Sign in with Apple, Google Sign-In).

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@glowid.ai of any unauthorized use.

2.3 You must provide accurate information and keep it up to date. You may not transfer, sell, or share your account with others.

3. Input Media, Generated Content, and Intellectual Property

3.1 Ownership of Input Media. You retain all rights you already hold in the photos, videos, and text prompts you upload or provide to Glowid ("Input Media"). You grant us a limited, worldwide, non-exclusive, royalty-free license to process, transmit, and temporarily store your Input Media solely for the purpose of providing the generation/editing feature you requested and for the operational purposes described in our Privacy Policy.

3.2 No use for AI training. We do not use your Input Media or the content generated from it to train, fine-tune, or improve any AI/machine learning model, whether ours or a third party's, and we do not permit our third-party AI processing providers to do so either. See our Privacy Policy for details.

3.3 Immediate deletion of Input Media. Once a generation or editing task is complete, your original Input Media is deleted from our processing systems; we do not retain your original uploaded photos or videos beyond the time necessary to complete that task (see Privacy Policy, Section 3).

3.4 Third-party AI processing. To generate content, Glowid transmits your Input Media and prompts to third-party AI model providers acting as our processors, including: BytePlus Pte Ltd, OpenAI, Google. These providers process the data solely to return the generated output to Glowid and are contractually/by policy prohibited from using it to train their own models beyond what is necessary to provide the service to us.

3.5 Generated Content. Subject to your compliance with these Terms, you may use content you generate through Glowid ("Generated Content") for personal or commercial purposes, to the extent permitted by applicable law. AI-generated output may not be unique, and we make no guarantee of exclusivity or originality.

3.6 You represent that you own or have obtained all necessary rights, licenses, and consents for any Input Media you upload, including consent from any identifiable individuals depicted, and that such Input Media does not infringe any third party's intellectual property, privacy, or publicity rights.

3.7 The Glowid application, brand, logo, and underlying software are the property of Sparking Labs Limited and are protected by intellectual property laws. No rights are granted to you except as expressly stated in these Terms.

4. Prohibited Uses

You may not use Glowid to create, upload, or distribute content that:

  • Depicts or sexualizes minors in any way, including child sexual abuse material (CSAM);
  • Depicts real, identifiable individuals in a sexual, defamatory, or non-consensual manner (including non-consensual "deepfake" style content);
  • Contains graphic violence, terrorism, or extremist material;
  • Infringes any third party's copyright, trademark, privacy, or publicity rights;
  • Is fraudulent, misleading, or impersonates any person or entity;
  • Promotes hatred, discrimination, or incites violence or illegal activity;
  • Otherwise violates applicable law.

We reserve the right to review, remove, or restrict access to any content that violates these Terms and to suspend or terminate accounts that repeatedly or seriously violate this Section, and to report unlawful content (such as CSAM) to appropriate authorities as required by law.

5. Subscriptions and Auto-Renewal (Please Read Carefully)

5.1 Subscription Plans. Glowid offers auto-renewing subscription plans (e.g., weekly, monthly, and/or annual). The exact title, duration, and price of each plan, and price per unit where applicable, are displayed on the in-app purchase screen at the time of purchase and are incorporated into these Terms by reference.

5.2 Payment. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.

5.3 Auto-Renewal. Subscriptions automatically renew for the same duration unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to (subject to advance notice of any price change as required by applicable platform rules).

5.4 Managing or Canceling Your Subscription:

  • iOS: Settings > [your name] > Subscriptions
  • Android: Google Play Store app > Profile icon > Payments & subscriptions > Subscriptions

Canceling stops future renewals; access continues until the end of the current paid period. No partial refunds are issued for unused time unless required by law.

5.5 Free Trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, and if you do not cancel before the trial ends, you will automatically be charged for the subscription.

5.6 Refunds. All purchases are processed by Apple or Google. Refund requests must be submitted directly through the applicable App Store or Google Play refund process; we cannot directly process platform billing refunds.

6. Disclaimers

6.1 AI-generated content is produced automatically by algorithmic models and may be inaccurate, unexpected, or unsuitable for your intended purpose. We make no representation as to the accuracy, quality, or fitness of any Generated Content.

6.2 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARKING LABS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

8.1 You may stop using the Service and delete your account at any time via in-app settings.

8.2 We may suspend or terminate your access if you violate these Terms, without prior notice where required to prevent harm or comply with law.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the app or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Sparking Labs Limited is incorporated, without regard to conflict-of-laws principles, except where mandatory consumer protection laws of your country of residence require otherwise. Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved informally, it shall be submitted to the courts having competent jurisdiction over Sparking Labs Limited, unless applicable law grants you the right to bring a claim in the courts of your own country of residence.

(Note: this generic formulation lets you avoid naming a specific country/state for now. It is enforceable in most jurisdictions but offers weaker predictability than naming a specific venue — you can tighten this later, e.g., by adding an arbitration clause, once your primary operating jurisdiction is finalized.)
